Chapter 1General Provisions
Article 1Purpose #
These Terms set out the rights, obligations, and responsibilities of the Operator and members, the conditions and procedures for using the Service, and other necessary matters in connection with the use of the mobile application service “JAMIT” (the “Service”) provided by Minjae Kim (김민재) (the “Operator”; contact: support@jamit.kr).
Article 2Definitions #
The terms used in these Terms have the following meanings.
- “Service” means the JAMIT mobile application and all related services provided by the Operator that allow members to complete a jam by uploading performance videos for each part (instrument, vocals, etc.) based on a specific section of an original song posted on YouTube, and to create, save, and share an Its that combines the participating tracks.
- “Member” means a person who has agreed to these Terms, entered into a service agreement through social login, and uses the Service.
- “Original song” means music video content posted on YouTube that serves as the basis of a jam. Original songs are not stored or distributed by the Service; they are played through YouTube.
- “Post” (or “Jam”) means a posting in which a member specifies a section of an original song and the parts to be recruited in order to recruit participants for a jam.
- “Track” means a performance video for a part (including video and audio) that a member records and uploads to join a post.
- “Its” means a short video created by combining the tracks gathered in a post and compositing them in a grid layout or similar format; its creator may save it to their device or share it outside the Service.
- “Chat” means the feature through which a member exchanges messages with other members within the Service, and includes both conversations between two members and chat rooms in which multiple members participate (including chat rooms attached to a Space).
- “Message” means text that a member sends in a chat, and posts, tracks, and Its that a member shares by including them in a message.
- “Content” means any and all materials that a member posts or uploads to the Service, including posts, tracks, Its, profiles, text, and messages.
Article 3Posting and Amendment of the Terms #
- The Operator posts these Terms on screens within the Service and on information pages so that members can easily review them.
- The Operator may amend these Terms to the extent that doing so does not violate relevant laws, such as the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- When amending the Terms, the Operator will give notice, stating the effective date and the reasons for the amendment, by in-Service notice, push notification, or other means, beginning 7 days before the effective date (or 30 days before, for changes that are unfavorable to members or material).
- If a member continues to use the Service on or after the effective date of the amended Terms, the member is deemed to have agreed to the amended Terms. A member who does not agree to the amended Terms may delete their account in accordance with Article 7.
Article 4Rules Not Covered by the Terms #
Matters not provided for in these Terms, and the interpretation of these Terms, are governed by relevant laws and general commercial practice. Matters concerning the processing of personal information are governed by the separate JAMIT Privacy Policy.
Chapter 2Service Agreement and Accounts
Article 5Formation of the Service Agreement #
- The service agreement is formed when a person who wishes to use the Service applies for membership through social login with a Kakao, Google, or Apple account and then agrees to each of these Terms and the Privacy Policy, and the Operator accepts the application. You cannot sign up for the Service without agreeing to these Terms.
- Only persons aged 14 or older may sign up for the Service. The Operator may terminate the service agreement for any account confirmed to belong to a person under the age of 14.
- Agreeing to these Terms includes agreeing to the zero-tolerance policy for objectionable content and abusive users under Article 16.
- The Operator may refuse to accept an application, or terminate the service agreement afterwards, in any of the following cases:
- A person previously excluded from the Service under Article 16 or Article 19 applies to sign up again
- The applicant used another person’s social account without authorization
- The application was made for an improper purpose or by improper means
Article 6Management of Accounts and Member Information #
- An account may be used only by the member themselves and may not be transferred or lent to anyone else.
- Members are responsible for managing their own social accounts and devices, and must notify the Operator immediately upon becoming aware of any unauthorized use by a third party. The Operator is not liable for any disadvantage arising from a member’s failure to manage these properly unless the Operator acted intentionally or negligently.
- If a member’s information, such as their profile, changes, the member must update it within the Service.
Article 7Account Deletion #
- Members may terminate the service agreement (delete their account) at any time using the in-app account deletion feature.
- Upon account deletion, the Operator invalidates the member’s login sessions and push tokens and also handles the removal of the social login link (Kakao, Google, Apple). For an Apple account, account deletion is processed only once the unlink has been completed; for Kakao and Google accounts, the link information held by the Operator is destroyed even if the unlink request fails or unlinking is not supported in the app environment. The member may remove the link directly in the account settings of each platform, and the details of this processing are governed by Article 7 of the Privacy Policy.
- The personal information of a member who has deleted their account is destroyed as set out in the JAMIT Privacy Policy. If you delete your account, the messages you sent will no longer be visible on the other party’s screen, and if no one remains in a chat room with multiple participants, the messages in that room, including those written by other members, follow the same procedure. Retention periods are governed by Article 3 of the Privacy Policy.
- Content uploaded by a member who has deleted their account (tracks, posts, Its) is handled as follows.
- Tracks uploaded by the member (originals, processed versions, and thumbnails) are no longer visible in the Service upon account deletion and are destroyed after the period set out in Article 3 of the Privacy Policy has passed.
- Its created by the member are handled in the same manner, whether or not they have been published. Its created by other members are retained even if they include the member’s tracks (Article 14(4)).
- A post written by the member is retained, with its author shown as “Unknown,” if other members’ tracks or Its remain on it; in this case, the reference video uploaded by the member is detached from the post and handled in the same manner as subparagraph 1. A post with no content from other members is handled in the same manner as subparagraph 1.
- Its that have already been shared or saved outside the Service (such as on social media) are beyond the Operator’s control, and the Operator therefore cannot guarantee their retrieval or deletion.
- For 30 days after deleting your account, you cannot sign up again with the same social account. If you delete your account while suspended under Article 19, you cannot sign up again until that suspension period ends (up to 1 year). The information the Operator retains for this purpose, and its retention period, are governed by Article 3 of the JAMIT Privacy Policy.
Chapter 3Use of the Service
Article 8Description of the Service #
- The Operator provides the following services:
- Creating, browsing, and joining jam posts based on sections of original songs
- Recording and uploading track videos for each part (using the device’s camera and microphone), and automatic sync correction
- Compositing, playing, saving to the device, and sharing externally Its that combine participating tracks
- Chat between members — delivery and storage of messages, display of read status, and management of chat room participants
- Additional features such as profiles, notifications, reporting, and blocking
- The Service is provided free of charge. If paid services are introduced, the Operator will give separate notice and obtain consent.
- The Service is, in principle, provided year-round without interruption, but it may be temporarily suspended when operationally necessary, such as for maintenance.
Article 9Playback of Original Songs and YouTube Services #
- Original songs are played through the player provided by YouTube, and their use is subject to the YouTube Terms of Service. By using the Service, members agree to be bound by the YouTube Terms of Service. The processing of personal information in the course of using YouTube is governed by Article 10 of the Privacy Policy.
- The Operator is not the rights holder of original songs, and the use of related posts and features may be restricted due to circumstances on YouTube’s side, such as an original song being deleted or made private or its embedding being restricted. In such cases, the Operator is not liable unless it acted intentionally or negligently.
Article 10Notifications #
- The Operator may send app push notifications that are necessary for using the Service, such as notifications of jam participation, Its publication, and incoming chat messages. Chat notifications may show the sending member’s nickname and the beginning of the message.
- Members may opt out of push notifications through their device settings or the settings within the Service. However, important notices regarding the operation of the Service may also be given by means other than push notifications.
Article 11Changes to and Suspension of the Service #
- The Operator may change all or part of the Service as operationally or technically necessary, and will give prior notice of material changes within the Service.
- The Operator may temporarily suspend the provision of the Service in the following cases:
- System inspection, maintenance, or replacement
- Power outages, equipment failures, surges in usage, or service interruptions by a facilities-based telecommunications carrier or a cloud provider
- Force majeure, such as natural disasters or national emergencies
- If the Operator intends to permanently discontinue the provision of the Service (termination of the Service), it will give notice within the Service or by other means at least 30 days before the termination date. In this case, members may back up their content before the termination date, for example by saving their Its to their devices.
- The Operator is not liable for damages arising from changes to or suspension of services provided free of charge, unless it acted intentionally or with gross negligence.
Chapter 4Content
Article 12Rights and Responsibilities for Content #
- Copyright and other intellectual property rights in content that a member posts on the Service belong to that member or the legitimate rights holder.
- When a member uploads content that uses works of others (including original songs), such as cover performances or cover vocals, the member who uploaded the content is responsible for confirming and clearing the rights required for it, such as copyright and neighboring rights. Members warrant that the content they upload does not infringe the rights of others, such as copyright, trademark rights, portrait rights, or reputation.
- If a dispute arises with a rights holder because of a member’s content, or if the Operator suffers damages (such as compensation paid or the cost of handling the dispute), the member who uploaded the content bears responsibility.
- If the Operator determines that a member’s content falls under the prohibited acts in Article 15 or violates relevant laws, it may delete or hide the content, or take other measures, without prior notice. However, for messages, the Operator takes the measures in this paragraph only when a report has been received under Article 16.
Article 13License to Use Content #
- For content they post, members grant the Operator a non-exclusive license, to the extent necessary to provide, operate, and improve the Service, to store, reproduce, encode, composite (including sync correction of tracks and grid compositing of Its), display, and transmit that content, and to view and analyze it internally within the Operator to improve the quality and usability of the Service. The purposes and scope of internal viewing and analysis are governed by Article 1 of the Privacy Policy.
- The license in paragraph 1 does not include use for the purpose of promoting the Service. If the Operator intends to use a member’s content to promote the Service (such as in advertising, posts on external channels, or app store promotional materials), it will obtain that member’s prior consent, and where content of multiple members is included together, such as in an Its of a jam, it will obtain the consent of each member.
- The license in paragraph 1 does not apply to messages. The Operator processes chat messages only to the extent of delivering and storing them and, when a report is received under Article 16, reviewing the reported message and the messages exchanged before and after it in the same chat room (up to 5 human-written messages on each side, including deleted messages), and does not subject them to internal viewing or analysis for improving the quality or usability of the Service.
- The license in paragraph 1 terminates when the member deletes the content or deletes their account. However, with respect to the handling of content upon account deletion under Article 7(4) and Its that have already been composited, that provision prevails, and to the extent that deleted content, or content of a member who has deleted their account, is retained for a certain period to review reports, Article 3 of the Privacy Policy prevails.
Article 14Jam Participation and Consent to Use of Likeness, Voice, and Performance #
- Tracks may include a member’s face, body, and voice, and their musical performance.
- By uploading a track to a post and joining a jam, a member is deemed to consent to the following:
- The track being shown and played to other users within the Service
- The member’s track (including the member’s likeness, voice, and performance) being included in the combination when another member who joined the same post creates an Its
- The creator of an Its so created saving it to their own device or sharing it outside the Service (such as on social media)
- The creator of an Its must include at least one track they uploaded themselves; an Its cannot be created from other people’s tracks alone.
- A member may withdraw consent to the future creation of Its by deleting their track. However, the withdrawal may not extend to Its that were already created and saved to a device, or shared outside the Service, before the deletion. Even if a member deletes their account, the member’s tracks included in Its created by other members are retained together with those Its, and the member consents to this by joining a jam. Its created by the member themselves are handled in accordance with Article 7(4), subparagraph 2.
Article 15Members’ Obligations and Prohibited Acts #
- Members must comply with relevant laws, these Terms, and the guidance provided within the Service.
- Members must not engage in any of the following acts:
- Posting obscene material, sexually objectifying content, or any sexual content involving children or adolescents
- Posting violent or gruesome content, or content that encourages self-harm or suicide
- Hate, discrimination, disparagement, harassment, threats, or stalking directed at specific individuals or groups
- Posting content that infringes the rights of others, such as copyright, portrait rights, or personal information (including footage of others recorded without their consent)
- Impersonating others or spreading false information
- Advertising, spam, repetitive posting, or mass posting of content unrelated to the purpose of the Service
- Unauthorized access to the Service’s source code, servers, or APIs, reverse engineering, or fraudulent use by automated means
- Repeatedly sending messages that the other person does not want in a chat, sending advertising or spam to chat rooms, or disclosing the contents of a conversation externally without the other party’s consent
- Misuse of the reporting feature (false or repeated reports)
- Any other act that violates relevant laws or is contrary to good morals
Article 16Zero-Tolerance Policy for Objectionable Content and Abusive Users #
- The Operator applies a zero-tolerance policy to objectionable content and abusive users.
- Members may report posts, tracks, Its, messages, or users through the reporting feature within the Service. Using the blocking feature under Article 18, members may block one-on-one conversations with a specific member; in chat rooms with multiple participants, the member remains in the room together with the blocked member, but their messages are hidden from each other.
- Within 24 hours of receiving a report, the Operator will check the content concerned and, if it is confirmed to be objectionable content, delete or hide it and exclude the user who posted it from the Service (suspension or permanent suspension). Any review following the initial check will be completed within 7 business days from the date the report was received.
- The Operator may operate pre- and post-screening measures to prevent objectionable content from being posted. Messages are not subject to this paragraph — the Operator does not look into the contents of conversations between members without a report (Article 13(3)).
- A member who objects to a measure taken under this Article may file an objection through support@jamit.kr, and the Operator will lift the measure if, upon review, there are justifiable grounds.
Article 17Reports of Rights Infringement and Takedown #
- A person who claims that their rights, such as copyright or portrait rights, are infringed by a member’s content (the “Claimant”) may, by substantiating that claim, request that the Operator delete the content or suspend its posting.
- Upon receiving a request under paragraph 1, the Operator will, in accordance with the procedures prescribed by relevant laws such as Article 103 of the Copyright Act, delete the content or block access to it without delay, and notify the person who posted the content and the Claimant.
- The person who posted the content may request that posting be resumed by substantiating that they hold legitimate rights, and the Operator will handle the request in accordance with the procedures prescribed by relevant laws.
- Channels for reporting rights infringement: the reporting feature within the Service or support@jamit.kr
Article 18User Blocking #
- Members may block other users, and content from a blocked user is not shown in the member’s feed, search, notifications, or elsewhere. In chat, one-on-one conversations with that user are closed; in chat rooms with multiple participants, the two remain in the room together, but their messages are hidden from each other. However, in rankings by part (instrument), ranks are shown regardless of any blocking between users.
- The other party is not separately notified of a block, and the member may unblock at any time.
Article 19Restrictions on Use #
- If a member violates these Terms or interferes with the normal operation of the Service, the Operator may, depending on the severity of the violation, take measures such as a warning, deletion of content, restriction of features, temporary suspension, or permanent suspension, either in stages or immediately. For a violation falling under Article 16, the Operator may impose a permanent suspension immediately without going through stages.
- When the Operator imposes a restriction on use, it will notify the member of the reason for and details of the restriction. However, where urgent action is required, notice may be given after the measure is taken.
- Members may object to a restriction on use, and if the objection is found to be justified, the Operator will lift the measure immediately.
- During a suspension, the member cannot log in to the Service, and when they attempt to log in, the reason for the suspension and the date it ends are displayed. Even if a member deletes their account during a suspension, the suspension period remains in effect, and during that period (up to 1 year) the member cannot sign up again with the same social account (Article 7(6)).
Chapter 5Obligations and Liability
Article 20Obligations of the Operator #
- The Operator does not engage in acts prohibited by relevant laws or these Terms, and endeavors to provide the Service on a continuous and stable basis.
- To protect personal information, the Operator establishes and discloses the JAMIT Privacy Policy and complies with it.
- If the Operator finds a member’s opinion or complaint to be justified, it will address it and inform the member of the progress.
Article 21Disclaimer #
- The Operator is not liable for disruptions to the use of the Service caused by natural disasters, force majeure, or reasons attributable to the member.
- The Operator does not guarantee the reliability, accuracy, or lawfulness of content posted by members, and has no obligation to intervene in disputes arising between members, or between a member and a third party, through content. However, the Operator will perform its obligations to take measures under Article 16 and Article 17 regardless.
- The Operator is not liable for damages incurred by members in connection with services provided free of charge, unless it acted intentionally or with gross negligence.
Article 22Compensation for Damages #
- If the Operator or a member causes damage to the other party by violating these Terms, it is liable to compensate for that damage.
- If a third party raises an objection or files a lawsuit against the Operator because of a member’s violation of these Terms, that member must hold the Operator harmless at the member’s own cost and responsibility, and must compensate the Operator for any damage incurred.
Chapter 6Miscellaneous
Article 23Governing Law and Jurisdiction #
- These Terms and matters relating to the use of the Service are interpreted and applied in accordance with the laws of the Republic of Korea.
- If a dispute arises between the Operator and a member in connection with the use of the Service, the parties will endeavor to resolve it through mutual consultation; if no agreement is reached, a lawsuit may be filed with the court having jurisdiction under the Civil Procedure Act.
AddendumEffective Date #
- These Terms take effect on August 25, 2026.
- Amendment of October 20, 2026 — This amendment reflects the chat feature, through which members exchange messages with one another. Definitions of chat and message were added to Article 2, and messages were included in the definition of “content”; chat was added to the description of the Service in Article 8 and to the notifications in Article 10; prohibited acts in chat were added to Article 15; and messages were added to the items that can be reported under Article 16. To match the name used on app screens, the Korean term for posts was changed from “게시글” to “모집글”; it refers to the same thing. The license in Article 13(1) does not apply to messages — the Operator processes messages only to the extent of delivering and storing them and reviewing reported messages, and does not subject them to internal viewing or analysis for improving the Service (Article 13(3), newly added). Also corrected — the wording on unlinking social logins in Article 7(2) was aligned with actual processing (for an Apple account, account deletion is processed only once the unlink has been completed); Article 18(1) now states that ranks are shown in rankings by part regardless of any blocking between users; the sign-up order in Article 5(1) was aligned with the actual order in the app (agreement after social login); and a link to the YouTube Terms of Service, together with a statement that members agree to those terms by using the Service, was added to Article 9(1). This does not change what is processed; the wording did not match the facts or had been omitted. Notice of this amendment was given in advance beginning September 18, 2026, and it takes effect on October 20, 2026. On the same date, the Privacy Policy is also amended. However, for members who agree to the amended Terms in the app before then, the amended Terms apply from the time they agree.
